While your at it, ask your lawyer if he ever subpoenaed an insurance company.

Here are three (3) facts that most lawyers do not know about insurance:

  1. The Insured can recover attorneys’ fees “reasonably incurred to compel payment of the policy benefits.”  Such fees are called Brandt Fees and they must be claimed and won to be awarded.  Ask your lawyer if he / she knows what Brandt Fees are.
  2. Insurance Companies may insist on a White Waiver.  You will be hard pressed find many lawyers who can tell you what a White Waiver is.  Ask your lawyer.
  3. Old insurance policies can still pay out.  For example, General Liability policies prior to around 1987 did not have pollution exclusions and those old policies can pay claims and a provide defense related to pollution that you discover today.  Ask your lawyer if he / she even knows that old policies might pay for current discovered damage or current lawsuits.
